The purpose of this study were 1) to study the hotel and accommodation business that unable to proceed legally in Khao Kho, Phetchabun 2) to study some barriers and solutions of hotel and accommodation procedure in Khao Kho, Phetchabun and 3) to search for solutions guideline for land in hotel and accommodation business including land use in Khao Kho, Phetchabun. Actually, the utilizing of this research findings bring into the applying ways for hotels, accommodations and land use in Khaao Kho, Phetchabun. All of these, in order to make coexist peacefully among people in Khao Kho. The research methodology adopted was qualitative research approach by documentary study. Data collection was conducted mainly through in-depth interview with stakeholders, and non-participant observation as well as focus group method.
Research results revealed that the running of hotel, accommodation, and land use in four sub-district areas can not operate by legal action way because of contradiction by National Forest Act B.E. 2507 (1964). Before the promulgation of this act, some people who originally lived since the army group invited them to residence and gave them some area for living. When the army hand over the national area to department of Forestry, people who lived in these areas before became the public land invaders and also arrested.
The barriers in the running of hotel and accommodation business as well as land use in Knao Kho, Phetchabun in conclusion were as follows; (1) the problems of hotel and accommodations business (2) insurance of documents certifying housing and land rights. (3) Dispute and problem in overlapping between national park, national forest area and community area (4) The treatment of public sector to people in enforcing forest law.
The guided solution for land use and hotel and accommodation business in Khao Kho, Phetchabun dived in to 4 choices as follows;
1. Firstly, the facilities from Article 16 of Forest Act, The Provincial Governor relying on Article 16 of National Forest Act to declare that people or legal person can request to use the land and then state official gave utilization of land certificate. By amendment to the law of Ministerial for Enforcement of Integrated Town Planning in Phetchabun.
2. Secondly, the declaration of Special Economic Zone because of the special feature of Khao Kho was differ from other area such as city of tourism, the complexity of environment etc.
3. Thirdly, the declaration of degraded forest zone in Khao Kho area . Because nowadays, Khao Kho became tourism city and Urbanization in eyewitness of everyone.
4. Finally, the declaration of state land according to State Property Act B.E. 2518 (1975) Article 18
However, final solution must ended by the role of Community Organization Council to propel and push for success in state policy as win – win design path by cooperation from all parts.
