งานวิจัยนี้ศึกษามาตรการทางกฎหมายในการส่งเสริมและสนับสนุนการวิจัยที่มีประสิทธิภาพ โดยมีวัตถุประสงค์ 4 ประการได้แก่ (1) เพื่อศึกษาปัญหาด้านกฎหมายที่เป็นอุปสรรคต่อการทำการวิจัยในมหาวิทยาลัยราชภัฏเพชรบูรณ์ (2) เพื่อศึกษากฎหมายที่เกี่ยวข้องกับงานวิจัยของ 9 มหาวิทยาลัยวิจัยแห่งชาติ (3) เพื่อศึกษาเปรียบเทียบระหว่างกฎหมายที่เกี่ยวข้องกับงานวิจัยระหว่าง 9 มหาวิทยาลัยวิจัยแห่งชาติ กับมหาวิทยาลัยราชภัฏเพชรบูรณ์ (4) เพื่อให้ได้มาตรการทางกฎหมายที่ส่งเสริมและสนับสนุนการวิจัยที่มีประสิทธิภาพในมหาวิทยาลัยราชภัฏเพชรบูรณ์ โดยการวิจัยนี้เป็นการวิจัยเชิงคุณภาพมีการดำเนินการวิจัยโดยใช้วิธีการสัมภาษณ์กลุ่มเป้าหมาย ได้แก่ เชี่ยวชาญที่เกี่ยวข้องกับกฎหมาย ระเบียบ ข้อบังคับ เกี่ยวกับงานวิจัย จำนวน 9 คน และการประชุมกลุ่มย่อยข้าราชการ พนักงาน เจ้าหน้าที่ และบุคลากรของหน่วยงานภาครัฐและเอกชนในเขตอำเภอเมืองจังหวัดเพชรบูรณ์ 2 กลุ่มๆ ละ 10 คน รวม 20 คน
ผลการดำเนินการวิจัยพบว่า เนื่องจากพระราชบัญญัติมหาวิทยาลัยราชภัฏ พ.ศ. 2547 มาตรา 4 กำหนดให้มหาวิทยาลัยราชภัฏเพชรบูรณ์เป็นนิติบุคคลและเป็นส่วนราชการตามกฎหมายว่าด้วยวิธีการงบประมาณในสังกัดสำนักงานคณะกรรมการการอุดมศึกษา ประกอบกับมาตรา 7 กำหนดให้มหาวิทยาลัยเป็นสถาบันอุดมศึกษาเพื่อการพัฒนาท้องถิ่นที่เสริมสร้างพลังปัญญาของแผ่นดิน ฟื้นฟูพลังการเรียนรู้ เชิดชูภูมิปัญญาของท้องถิ่น สร้างสรรค์ศิลปวิทยาเพื่อความเจริญก้าวหน้าอย่างมั่นคงและยั่งยืนของปวงชนมีส่วนร่วมในการจัดการ การบำรุงรักษา การใช้ประโยชน์จากทรัพยากรธรรมชาติและสิ่งแวดล้อมอย่างสมดุลและยั่งยืนโดยมีวัตถุประสงค์ให้การศึกษา ส่งเสริมวิชาการและวิชาชีพชั้นสูง ทำการสอน วิจัย ให้บริการทางวิชาการแก่สังคม ปรับปรุง ถ่ายทอด และพัฒนาเทคโนโลยี ทำนุบำรุงศิลปะและวัฒนธรรม ผลิตครูและส่งเสริมวิทยฐานะครู ดังนั้น จึงทำให้มหาวิทยาลัยราชภัฏเพชบูรณ์ต้องตกอยู่ภายใต้กฎระเบียบต่าง ๆ ของระบบราชการ จึงทำให้เกิดความคล่องตัวน้อยกว่ามหาวิทยาลัยทั้ง 9 แห่ง ได้แก่ (1) จุฬาลงกรณ์มหาวิทยาลัย (2) มหาวิทยาลัยมหิดล (3) มหาวิทยาลัยเกษตรศาสตร์ (4) มหาวิทยาลัยเชียงใหม่ (5)มหาวิทยาลัย ธรรมศาสตร์ (6) มหาวิทยาลัยขอนแก่น (7) มหาวิทยาลัยสงขลานครินทร์ (8) มหาวิทยาลัยเทคโนโลยีพระจอมเกล้าธนบุรีและ (9) มหาวิทยาลัยเทคโนโลยีสุรนารี ที่เป็นมหาวิทยาลัยในกำกับของรัฐ ประกอบกับวัตถุประสงค์ของมหาวิทยาลัยราชภัฏเพชรบูรณ์ที่มุ่งเน้นการวิจัยเพื่อการพัฒนาท้องถิ่น จึงทำให้แนวทางการบริหารงานวิจัยแตกต่างจากมหาวิทยาลัยทั้ง 9 แห่ง ที่มุ่งเน้นการเป็นมหาวิทยาลัยชั้นนำทางด้านงานวิจัยเพราะเป็นมหาวิทยาลัยวิจัยแห่งชาตินั่นเอง
มหาวิทยาลัยราชภัฏเพชรบูรณ์จึงควรมีมาตรการทางกฎหมายที่ส่งเสริมและสนับสนุนการวิจัยที่มีประสิทธิภาพ อาทิ กำหนดให้ค่าตอบแทนคณะผู้วิจัยได้ไม่เกินร้อยละ 20 ของงบประมาณทั้งหมดที่ได้รับ ในกรณีการดำเนินงานวิจัยเร่งด่วน หรือความจำเป็นในการใช้จ่ายเงินวิจัยเป็นงวดเดียว ให้อยู่ในดุลพินิจของผู้อำนวยการสถาบันวิจัยและพัฒนาแห่งมหาวิทยาลัยราชภัฏเพชรบูรณ์ เป็นต้น
This research studies the legal measures to promote and support effective research of Phetchabun Rajabhat University with 4 objectives which are (1) to study legal problems that hinder the research in Phetchabun Rajabhat University (2) to study the laws related to the research of 9 National Research Universities (3) to study the comparison between laws Related to research between 9 national research universities And Phetchabun Rajabhat University (4) to establish a legal measures to promote and support effective research in Phetchabun Rajabhat University. This research is a qualitative research. The research has been conducted by interviewing the target group, including expertise related to the law, research regulations, total of 9 people and a focus group meeting, civil servants, staff and personnel of government agencies divided as 2 groups, 10 persons each, total 20 persons.
The results of the research showed that the Rajabhat University Act 2004 Section 4 stipulates that Each Rajabhat University, including Phetchabun Rajabhat University, shall be regarded as a juristic person and as a government sector under the Law of Budgetary Means, reporting to the Office of the Board of Higher Education. In addition, Section 7 stipulates that The University is an institute of higher education for local development in order to help reinforce national intelligence, revive the learning force, promote local wisdom, create artistry for secure and sustainable prosperity of the people, take part in managing, maintaining, utilizing natural resources and environment on balance and sustention basis under the objectives of providing education, enhancing advanced knowledge and professionalism, providing lessons, researching, providing academic services to society, improving, transferring, and developing technology, maintaining arts and culture, generating teachers and enhancing the academic standing of teachers. Therefore, Phetabun Rajabhat University must fall under the rules and regulations of the bureaucratic system. Resulting in less flexibility than all 9 universities, (1) Chulalongkorn University (2) Mahidol University (3) Kasetsart University (4) Chiang Mai University (5) Thammasat University (6) Khon Kaen University (7) Prince of Songkla University (8) King Mongkut's University of Technology Thonburi and (9) Suranaree University of Technology, that are autonomous universities.Therefore, the research management approach is different from the 9 universities that focus on being a leading research university because it is a national research university.
Phetchabun Rajabhat University should have the legal measures to promote and support effective research, such as stipulating the research team compensation cannot exceed 20 percent of the total budget received. In the case of urgent research or the need to spend research funds in a single installment. The researcher has to get the permission from the Director of the Research and Development Institute of Phetchabun Rajabhat University etc.
